It is considered that the presumption of innocence is a fundamental principle, as well as a right, which originates in the general goal of the criminal procedure. It is a guarantee,which ensures that no innocent person is condemned. It also guarantees the responsibility of the judicial bodies to administer the proper evidence to prove the accusation and to conclude, in case of the absence of such evidence, the innocence of the accused.
