Promovarea politicilor migraţiei de muncă în cadrul Uniunii Europene This article addresses the issue of labor migration in the European Union. The analysis of the contributions showed a general support for a common EU policy an labour immigration, albeit with important differences in the approaches to be followed and in the expected end result. Building on the existing framework, this Policy Plan defines a road-map for the remaining period of The Hague Programme and lists the actions and legislative initiatives that the Commission intends to take, so as to pursue the coherent development of the EU legal migration policy. It also responds to the Commission’s Lisbon programme.

Situaţia demografică de pe mapamond şi evoluţia populaţiei Republicii Moldova This article deals with the evolution of the world demographic tendencies, ominous demographic situation in Europe, indices of fruitfulness in different countries and the evolution of the number of inhabitants on the world map in the future. Much attention has been paid to the dynamics of the population in the Republic of Moldova since Independence, the process of depopulation in localities, birth rate, migration, ageing of the population and national demographic expectation. The author also speaks about the necessity of scientific research in the demographic field and supports orientations of the demographic policies in practice according to the vital needs of the country and its social-economic development.

Ce trebuie să ştim despre o evoluare publică? The activity of public functionaries includes diverse performances in public, so the skills of eloquence are extremely needed by them. For the majority of public functionaries the appearances in front of the numerous audience is often stressful if they have never got the training in the skills of eloquence. The authors of this article have the intention to provoke readers to take an interest in some subjects related to the rhetoric (particularities of the types of rhetoric and rules of public performance to use effectively while speaking in public). This knowledge will help public functionaries deliver persuasive discourses.

Therefore, in early 2003, Japan launched the brand strategy named “Yōkoso! Japan”, the aim of which was to attract annually 10 million foreign tourists by the end of 2010.

Depunerea jurământului în contextul diversităţii condiţiilor de apariţie a raporturilor de serviciu şi a celor de exercitare a funcţiei (raporturi juridice de muncă atipice) Dans cet article l’auteur trait la pluralité des conditions d’apparition des rapports juridiques de travail atypiques, qui s’étend dans le champ des pouvoirs publics: des rapports de service des fonctionnaires publics et, respectivement, des rapports d’exécution de la fonction des dignitaires d’état. Un rôle particuliér est consacré à la prestation de serment comme une condition particulière d’apparition des rapports juridiques de travail atypiques. Selon l’auteur, la naissance du rapport de service et même du rapport d’exécution de la fonction se produit dans des étapes. Premièrement par le dépôt de la demande de participation au concours pour la substitution de la fonction, et puis par le dépôt du serment qui est le point final dans la génération deces rapports.

To elucidate this issue, references to the author’s opinion towards this subject were made, and specific features and characteristics were found. In this context, were overlooked the specific characteristics of the method of legal regulation of labor law. As a conclusion to the subject, we appreciate that the method of legal regulation of labor law has a dichotomous nature in that it is divided in the method of coordination for collective relations and the method of ordering the individual employment relationship.

Federalismul şi descentralizarea administrativă din perspectiva redimensionării principiului separaţiei puterilor L’organisation des collectivités locales a été regardée à partir de son interprétation fonctionnelle mais la question de la centralisation-décentralisation est généralement laissée à l’écart de la théorie de la séparation des pouvoirs, même si elle apparaît en filigrane. L’idée de Montesquieu selon laquelle les trois puissances du pouvoir „par le mouvement nécessaire des choses, ... sont contraintes d’aller, elles seront forcées d’aller de concert”, fonde une unité qui permet d’appréhender les rapports entre les organes centraux et non-centraux. Pour réaliser cette unité, Montesquieu propose de diviser la production de la norme en distinguant la faculté de statuer remise à un organe de la faculté d’empêcher remise à un autre organe.

Specificul soluţionării litigiilor individuale de muncă din sectorul privat In the private the legal relationship between employee and the employer are based on the employment contract. Employment contract is the foundation of the existence and further development of relations that appear in the work performance. Employer’s refusal to legalize the labor relations by concluding in writing the labor contract with the employee is in violation of labor laws that are prejudicial to him, depriving him of certain rights, eg the right to social protection when the employee was unit was fired or liquidated.

Unele reflecţii juridice privind reglementarea legală a grevei patronale (a lock-out-ului) In the employment relationship, a lock-out occurs when management shuts down company operations to prevent union workers from working. It is a tactic typically used by employers to hinder union organization or to gain leverage in labour disputes. In this connection, the author of the given research paper has elucidated some aspects of the legal nature of the lock-out according to the labour legislation of the Republic of Moldova and other countries.

Beneficii şi costuri de aderare a Republicii Moldova la Uniunea Europeană In this article are investigated benefits and costs of the Republic of Moldova for accession to the European Union. Moldova’s integration to the EU would favour the creation of a range of State benefits, among which we could mention as being the most important: participation in the processes of political, economic, social and cultural institutions, both in the European area and worldwide. For any State, joining the EU means reinforcing democracy, full participation in the European Community institutions, economic development, improving living standards, a wide range of opportunities for development and modernization of the State, increasing foreign direct investment, access to the European labor market, security and protection. At the same time there are lots of costs which Republic of Moldova has to surpass. A series of political transformations, economic, social and cultural right should take place at all levels of society. Costs of accession are largely inevitable change costs to come out of the crisis caused by the collapse of the centralized economy.

Dimensiunea transparenţei administrative – oportunitate amplificată de dispozitivele comunicaţionale This paper is studying administrative transparency as an output of a long-term evolution and constant efforts to promote citizen best interest in the public affairs by ensuring and enforcing access to the information. Current changes in approaching administrative transparency’s concept are nothing but a reaction to the crisis of the authoritarian state as well as to the establishment of representative democracy, as well as to the necessity to reevaluate citizen’s role and position in the decision-making process in the Republic of Moldova. Furthermore, opinions stated in the present paper are mostly founded on the idea that currently, the dimensions of the administrative transparency are amplified by numerous communicative tools, dictated by the public administration reform in the Republic of Moldova.

Aplicaţii ale metodologiei de monitorizare şi evaluare a implementării cadrului normativ al serviciului public în Republica Moldova In this article some results are presented on the practical application of the monitoring and evaluation methodology for the enforcement of the civil service legal framework: the dynamic analysis has been carried out for the indicators on the application in the central specialized bodies of the following staff procedures during 2010-2012: merit-based employment, including competition, probation for junior civil servant, performance appraisal and professional development of civil servants. Also, the recommendations are formulated on improvement of the monitoring and evaluation mechanism for the enforcement of the civil service legislation.

Aspecte ale implementării e-Serviciilor publice în Republica Moldova Governments around the world are beginning to adapt their services according to the new requirements and expectations of citizens, using increasingly more innovative information technologies in the current activity. Such governments become more efficient, smarter and better able to meet the challenges of time. Republic of Moldova is also included in this process. For our country, in the digitization of public service, priority is given to the services required by citizens and businesses, and services needed reforms and European integration. Implementation of e-government services requires cooperation between public authorities and their interconnection automated information systems in a unified information space. Only in this way will successfully implement e-government in the Republic of Moldova, which will ensure the modernization process of decision-making, transparency and provision of e-government services that are more operational and effective in comparison with those traditionally provided.
