Formarea statului Moldovenesc şi constituirea sistemului tradiţional de administrare (III) The foundation of the Moldovan State, six and a half centuries ago, is perfectly integrated into the complex historical process of the configuration of medieval states conceived as superior form of organizing the social life within some well-established territorial spaces. These historical phenomena of major importance led to the establishment of some individual administrative systems within each newly created state. The elucidation of the process of forming the Moldovan State and the creation of its administrative system allows us to undertake analysis regarding the formation of state institutions and of administrative system of all levels.

Managementul schimbării. Unele aspecte în sectorul public Constant changes of the contemporary world deal with all the levels of the socio-economic, political, cultural, etc life. Private companies, which permanently study the market, display a keen interest towards the changes that take place in the environment and develop their organization in accordance with these changes. Such an interest can insure the survival of the company in the competitive environment. The public companies, in their turn, do not function in isolation from what happens around them and from the private companies and the customers’ growing demands towards the offered services, etc. Thus, the importance of a new public management approach towards sustainable organizational change is becoming imperative at the moment.

Infracţiuni în domeniul informaticii The rapid development of informational and communication technologies have brought numerous negative aspects to the foreground. On the one hand, it permits a kind of criminality which could not be possible without the information systems; on the other hand, it offers increased opportunities of committing traditional infringements. Before the epoch of distributed informational systems, the main concern regarding the security of informational data consisted in maintaining their confidentiality, a thing which could be realized through a simple physical protection (for example, by locking or leaving the information in special places where it was kept). Alongside confidentiality, some other important aspects appeared nowadays. The security of informational systems becomes very complex and causes worries to all types of organizations, being at the same time a legal requirement.

The notion of performance and its characteristics are also clarified. The standards of performance of professors and managers and the indices of standards are being discussed. Развитие национальных иновационных систем в ЕС The necessity of research of the National Innovation Systems in the context OECD recommendations has been grounded in this article. Structure and institutional framework of the National Innovation System, methodological approaches to an evaluation of information streams, procedure of industrial cluster analysis on purpose of the technical-scientific foundation of the Innovation Policy have been considered. Scientific and practical recommendations on using of the European Union’s experience adapted to the conditions of the formation of the National Innovation System in countries with transitive economy have been proposed.

Întreprinzătorul - promotor al afacerilor The modern entrepreneur’s necessary characteristics, as well as his roles in society, are determined. The author comes to the conclusion, that the motivational complex of the entrepreneur is the most important factor for the entrepreneurship activity. The author proposes a testing and evaluation variant of the motivational complex of the entrepreneur, by commenting on its various motivational formulae.

Cadrul legal privind promovarea şi asigurarea principiului transparenţei The international experience demonstrates that citizens’ participation is an efficient instrument in influencing local development. Its advantages are manifested in the increase of the quality of the decision process, the consolidation of partnerships, the attraction of new funds and rational use of existent resources, the creation of a benefic image, and the increase of public administration authority. It is well-known that the transparency of public authorities and especially the continuous flux of information addressed to people is a precondition of efficient community participation. The lack of transparency in the administrative process and, implicitly, in the decision making one, represents one of the most serious obstacles in the creation of a democratic society. Citizens’ unlimited access to information of public interest and their participation in decision making.

Considerente asupra sistemului constituţional în statele Europei Centrale şi de Est This paper presents a preliminary attempt to account for variation in changes in presidential power across post-communist presidential governments. It argues that economic reforms that produce concentrated economic benefits lead the winners from reform to seek institutional change in the powers of the presidency. Where the party system is too weak to protect their gains (and too weak defend the parliament as an organization), the winners from economic reform have strong incentives ally with the president to push for greater power for the executive. In the post-communist world countries with a rapid redistribution of wealth and fragmented party systems have experienced the greatest expansions of presidential power.

The adhesion of the Republic of Moldova to the Council of Europe and the ratification of the European Convention for the Protection of Human Rights and of its additional protocols imposed a very detailed analysis of the legislation into force, according to actual social necessities and to criteria of a rule of law, as well as the study of all provisions that are contrary to the Universal Declaration of Human Rights.

Consideraţii metodice privind elaborarea fişelor de post pentru funcţionarii din administraţia publică locală This study is addressed first of all to experts of local public administration. There are elucidated the advantages of the elaboration and application of job descriptions from the employees’ perspective and from the employers’ perspective. It is analyzed the legal support and there are determined the responsibilities of local factors of decision concerning the elaboration of job descriptions. There are presented and described the constitutive leading elements of a job description. In the completion of theoretical reflections it is presented a model structure of a job description, in the author’s view.

Evoluţia teoriei administraţiei publice în ţările europene The permanent tendency of public administration reform and development is characteristic of the modern society. In these circumstances, deep knowledge of the administrative phenomenon for ensuring a balanced organization and a perfect running of the public administration is required. The task is accomplished by the science of administration, which aims at a complete study of the theory and the practice of the public administration, trying to emphasize on the regularities that represent the basis of its organization and running. The knowledge of the theory and practice of other countries’ administration is particularly important for the process of the creation of a modern administration in the Republic of Moldova. From this point of view, European community countries present special interest for us. Therefore, we make an analysis of the evolution of the public administration theory in Great Britain, France, and Germany.

Comunicarea politică - component intrinsec al vieţii sociale contemporane Nowadays, political communication has become an intrinsic component part of the social life and more and more public servants display an increased interest in this activity. Generally, it can be affirmed that political communication is a field in which various persuasive modalities and forms of the electorate are intersected. The article analyses the proposed by different specialists I the field definitions in order to identify the specifics of political communication. The author proposes a succinct characteristic of the essential forms of political communication such as: presidential communication, governmental communication, local communication, party communication, electoral communication. The peculiarities of the political marketing and of its instruments in political communication are also specified. The aim of the article is to initiate the readers into the essence of the topic.

Tradiţia instituţională bizantină în Moldova medievală The fall of Constantinople in 1453 under the Ottoman Turks did not mark the disappearance of the Byzantine civilization and of its whole institutional, religious and cultural, thesaurus. The Byzantine idea and the values of the Byzantine world were taken over by a number of peoples from South-East Europe, which were later transmitted to future generations. The Byzantine institutional tradition was also continued in the Country of Moldova (Ţara Moldovei), whose rulers used the Byzantine precedent for the organization of the state and its institutions. Without officially declaring themselves as successors of the Byzantine kings, the rulers of Moldova perpetuated the political and religious values of this great civilization. They assumed the role of defenders of Christianity against the Ottoman expansion and raised Moldova to the rank of a new center of Eastern Christianity.

Formarea Statului Moldovenesc şi constituirea sistemului tradiţional de administrare (II) The present compartment of the study, dedicated to the 650 anniversary since the creation of the Moldovan State, is aimed at the analysis of the contribution of state functionaries to the constitution and development of the Moldovan culture. It was namely through culture that the Moldovan State and the traditional system of administration were strengthened. This is an novel tentative, as such thematic studies have never been undertaken until now, not even in the fundamental work elaborated and published by us within the Academy “The History of Public Administration from Moldova”. Obviously, the central and local administrative structures of the Moldovan State were plenary concerned.

Administrarea publică - fenomen social sistemic The public administration system is "a system of social organization based on relationships that exist between people who carry a specific activity called pub lic administration ". The administration is both part of the social environment and social environment itself. Its ultimate goal is to serve the society that created it and to meet the human legitimate rights and interests. Administration is a body in a set of social structures having a primary place in the global society, which is inserted from other organizations or human groups structured hierarchically, lie social environment and its evolution influence the activity and the structure of Administration, but at the same time, the Administration influences the social environment. Administration and its institutions is presented as a structured set of ojficials and social bodies through the mutual relations with other organizations within the global society in order to perform the tasks pursued jointly or separately. Thus, there is a close link between the administrative phenomenon and the global society, as Administration is determined by the social organization whose demands it meets, as well as the collective behavior, and, therefore, we can real ize the sociologic explanation of the administration phenomenon. As part of the social system, public administration has two indispensable essential components and namely: the structural-organic and the functional elements. The compatibility of the Public Administration system with the overall social one presupposes the mutual admittance of the needs they both have in common. Tliis knowledge is achieved by the spread of the information flow in both direclions within the mentioned systems, as well as, through multiple forms of social participation of the public administration system.

Motivarea nonfinanciară a funcţionarilor din administraţia publică The modern management's approaches and tendencies are based on a key principle related to design and implementation of a new employee motivation and retention system in order to achieve the objectives at the highest level possible. The motivation and stimulation of the civil servants is regulated by the Law on public junction and statute of civil servant no. 158-XVI dated 4 July 200H. In this context, based on Art. 40, the civil servant is motivated based on appreciated per formance and spirit of initiative, as well by receiving diplomas for specific results. If the civil sen-ant has demonstrated great performance at the workplace, merits for the society and state, he can be decorated with state distinctions. Motivation can be divided into two types: financial, that includes different forms of financial stimulation/incentives for the work done (basic salaiy, pension, financial aid. awards etc.), and non-financial, that includes forms of remuneration and stimulation that are not offered in terms of direct money/financial incentives to the employees (promotion, professional development, public recogCT) nition of shown performance, respect etc.). In this article we have proposed to explore topics related to non-financial motivation.

Rolul Consiliului Europei în democratizarea societăţii din Republica Moldova The present article is dedicated to the cooperation of Moldova with one of the international organizations of great influence on the European continent, namely the Council of Europe. There are reviewed briefly the main activities of the Coun cil of Europe in the democratization of Moldovan society, such as building the rale of state law, respecting human rights, preparing democratic elections, in creasing the role of media in society, NGOs, etc. It is also considered the coop eration with the Moldovan authorities with the Information Office of the Council of Europe in Moldova. The end of the article contains necessary conclusions and certain proposals are made.
