Specificul soluţionării litigiilor individuale de muncă din sectorul privat In the private the legal relationship between employee and the employer are based on the employment contract. Employment contract is the foundation of the existence and further development of relations that appear in the work performance. Employer’s refusal to legalize the labor relations by concluding in writing the labor contract with the employee is in violation of labor laws that are prejudicial to him, depriving him of certain rights, eg the right to social protection when the employee was unit was fired or liquidated.

Unele reflecţii juridice privind reglementarea legală a grevei patronale (a lock-out-ului) In the employment relationship, a lock-out occurs when management shuts down company operations to prevent union workers from working. It is a tactic typically used by employers to hinder union organization or to gain leverage in labour disputes. In this connection, the author of the given research paper has elucidated some aspects of the legal nature of the lock-out according to the labour legislation of the Republic of Moldova and other countries.

Beneficii şi costuri de aderare a Republicii Moldova la Uniunea Europeană In this article are investigated benefits and costs of the Republic of Moldova for accession to the European Union. Moldova’s integration to the EU would favour the creation of a range of State benefits, among which we could mention as being the most important: participation in the processes of political, economic, social and cultural institutions, both in the European area and worldwide. For any State, joining the EU means reinforcing democracy, full participation in the European Community institutions, economic development, improving living standards, a wide range of opportunities for development and modernization of the State, increasing foreign direct investment, access to the European labor market, security and protection. At the same time there are lots of costs which Republic of Moldova has to surpass. A series of political transformations, economic, social and cultural right should take place at all levels of society. Costs of accession are largely inevitable change costs to come out of the crisis caused by the collapse of the centralized economy.

Dimensiunea transparenţei administrative – oportunitate amplificată de dispozitivele comunicaţionale This paper is studying administrative transparency as an output of a long-term evolution and constant efforts to promote citizen best interest in the public affairs by ensuring and enforcing access to the information. Current changes in approaching administrative transparency’s concept are nothing but a reaction to the crisis of the authoritarian state as well as to the establishment of representative democracy, as well as to the necessity to reevaluate citizen’s role and position in the decision-making process in the Republic of Moldova. Furthermore, opinions stated in the present paper are mostly founded on the idea that currently, the dimensions of the administrative transparency are amplified by numerous communicative tools, dictated by the public administration reform in the Republic of Moldova.

Aplicaţii ale metodologiei de monitorizare şi evaluare a implementării cadrului normativ al serviciului public în Republica Moldova In this article some results are presented on the practical application of the monitoring and evaluation methodology for the enforcement of the civil service legal framework: the dynamic analysis has been carried out for the indicators on the application in the central specialized bodies of the following staff procedures during 2010-2012: merit-based employment, including competition, probation for junior civil servant, performance appraisal and professional development of civil servants. Also, the recommendations are formulated on improvement of the monitoring and evaluation mechanism for the enforcement of the civil service legislation.

Aspecte ale implementării e-Serviciilor publice în Republica Moldova Governments around the world are beginning to adapt their services according to the new requirements and expectations of citizens, using increasingly more innovative information technologies in the current activity. Such governments become more efficient, smarter and better able to meet the challenges of time. Republic of Moldova is also included in this process. For our country, in the digitization of public service, priority is given to the services required by citizens and businesses, and services needed reforms and European integration. Implementation of e-government services requires cooperation between public authorities and their interconnection automated information systems in a unified information space. Only in this way will successfully implement e-government in the Republic of Moldova, which will ensure the modernization process of decision-making, transparency and provision of e-government services that are more operational and effective in comparison with those traditionally provided.

Evaluarea calităţii vieţii la nivel zonal în Republica Moldova prin metoda sondajului public On the basis of the multidimensional concept of quality of life (QOL), which the author sees as macroeconomic vector influenced by many endogenous and exogenous factors of economic activity areas, the author suggests evaluating enterprisewide QOL by public survey of its employees. The author has developed sociological survey related to the evaluation of working conditions and company employees affect QOL (like the economic agents),providing the working conditions and causes employee satisfaction with income, work, interpersonal relations within the company, etc. and finally, life. The Author comes to relevant conclusions, that the satisfaction with life or QOL in Moldova is closely related to the salaries, and job satisfaction - income levels, interpersonal relations and education level. Because of those who were interviewed, the percentage of those who have decent pay is low (administration workers) and the satisfaction level is very low: only 4% of respondents are satisfied with life, 82% - are dissatisfied and 4% -do not know what to say.

Valorificarea resurselor umane prin prisma stimulării creativităţii Creativity is an inexhaustible source of power and energy, is a progress key factor in the contemporary world development and which can tackle any problem. Promoting individual creativity, but especially collective creativity, is a solution for mankind as a chance of survival and progress. In turn creativity is not just receiving and using again, but first, creating the new. People create because they feel the need of essential development, by writing they grow intellectually and by producing they must already hold the knowledge. To solve various crises for implementing changes also it is need to stimulate the creativity.

Правовое регулирование пенсионного обеспечения в Украине This article provides an overview of the pension system in Ukraine. Three levels of pensions are characterized: solidarity, savings and private pension provision. It shows the stages of formation of the legal regulation of the pension system. The study uses statistics on the number of pensioners and the average size of pensions. The article points out the key problems of effective functioning of the pension system. Separately, the author referred to the issue of discriminatory provisions of the pension legislation in need of reform. The overall conclusion of the need to codify pension legislation has been made. And in addition - the unification and harmonization of general and special pensions.

Impactul relaţiilor politico-administrative asupra culturii organizaţionale a administraţiei publice locale It is obvious that every policy change entails significant changes, especially in the leadership positions. Practice is difficult to acceptable European standards and other states with consolidated democracy, but that seems to perpetuate us despite pressure from international bodies. It is true that in recent years it has experienced an attenuation, so through successive legislative changes but also because of a slight change in the attitude of the political class. Yet many of those who have been replaced by political criteria based access in the same manner and accept this change as a natural fact. There are many situations in which attempts presentation of removal from office due to incompetence, or some people leave the public to the private sector where higher revenues.

Mesager şi cronică a ştiinţei administraţiei şi practicii administrative din Republica Moldova The present study examines the role of the Public Administration journal in the process of establishment and development of science of public administration in the Republic of Moldova, which gained favorable conditions for its expression and evolution in terms of modern paradigms assumed by an independent state. Since the Academy of Public Administration under the President of the Republic of Moldova was established in 1993, the training process of the public administration staff was initiated, but also scientific researches in the field of public administration started. Along with other activities, in order to facilitate this process, it was held the Public Administration, a methodical and scientific journal produced by the Academy, first published on December 1993. The Public Administration journal’s impact is examined in terms of its contribution to the development of science of public administration, promoting the state policy in the field of public administration, studying and dissemination of advanced experience on administrative activity, as well as enhancing the administrative culture of the administrative civil servants and its contribution to build a modern public administration in the Republic of Moldova.

Caracteristica şi modul apariţiei litigiilor individuale de muncă Of labor disputes are conflicts between employee and employer that can be solved by direct negotiations between the parties or with the participation of trade unions for the establishment or modification of working conditions their applications, conclusion, amendment and implementation of a collective agreement, on the social and working conditions. The employment disputes means the differences of the subjects of law and the law enforcement work, as well as other laws on labor, collective bargaining and other agreements, and the establishment of new or change the existing terms of labor occupancy, which is not covered by labor law.

Probleme actuale ale controlului de legalitate al actelor autorităţilor administraţiei publice locale Moldova’s strategic vector is joining the European Union. This membership requires that Moldova has achieved stability of institutions guaranteeing democracy, the rule of law, human rights. An important objective of achieving European integration is to ensure the legality in all fields of the state, including local government, which will increase the administrative capacity of municipalities and districts. If Moldova is failing to strengthen administrative capacity, this fact will present an obstacle to the process of European integration. In the present agrticle, the author examines some theoretical and practical aspect of the legality of the control of the acts of local public administration.
